Registered offender pleads not guilty to sex crime and assault

2020欧洲杯体育官方网站A 23-year-old registered sex offender pleaded not guilty Tuesday in Montana’s Sixth Judicial District Court to charges alleging he had sexual intercourse without a woman’s consent and seriously injured her.

Devin Durusky Landucci, who was represented by Mary Kramer of the Office of State Public Defender, made his initial appearance Tuesday before Judge Brenda Gilbert. He was led into the courtroom by staff from the Park County Detention Center, where he’s being held with bond set at $50,000.

2020欧洲杯体育官方网站Landucci on Tuesday entered not guilty pleas to felony charges of sexual intercourse without consent and aggravated assault. Gilbert continued his $50,000 bond, which was set last month by Justice Court Judge Linda Cantin.

Gilbert also set a number of conditions on his possible release on bond, including that he stay in touch with his attorney, obey all laws and avoid all contact with the alleged victim and any witnesses and their families.

Landucci was charged after a woman reported being at Landucci’s residence on Jan. 26 and the two had consensual intercourse that became non-consensual, causing injuries to the alleged victim that required surgery at Livingston HealthCare, charging documents said.

Officers with the Livingston Police Department responded to the hospital to speak with the victim, but were notified by nurse Shannon Gaines that the woman was going into surgery for her injuries, documents said.

Detective Joseph Harris met with the alleged victim, her friends and hospital staff on Jan. 27 at the hospital, documents said. The woman’s friends told Harris that doctors spent more than an hour stitching up the alleged victim internally, documents said.

2020欧洲杯体育官方网站The woman had a CAT scan and suffered from blood clots, hematoma and profuse bleeding, documents said.

“No medical personnel that Detective Harris spoke with, including Shannon Gaines, had ever seen injuries this significant in relation to a sexual assault,” charging documents said.

Detective Harris also met with Landucci later that morning on Jan. 27 for an interview.

2020欧洲杯体育官方网站Landucci told Harris during the interview that he and the victim were in the shower “experimenting” and that she was bleeding from it and he told her she would be fine, charging documents said.

Landucci agreed that he hurt the woman, but that it was not intentional, documents said. Landucci said he did not think the woman was in danger or significantly injured, documents said.

Charging documents allege the offense occurred in the 1400 block of East Gallatin. Landucci told Judge Cantin last month that he’s currently not working and lives with family. He said he’s been in Montana for about seven and a half years, previously living in Caldwell, Idaho. 

Detective Harris said Landucci lives between Bozeman and Livingston, but mostly in Livingston, and that Landucci is currently on probation for a 72-month deferred sentence handed down for a 2014 offense of sexual intercourse without consent out of Cascade County. The victim in the 2014 case was a 12-year-old female, according to records from the Montana Department of Corrections.
